Indemnification

You agree to indemnify, defend and hold harmless Interisland Airways, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to compliment our services from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement.

Miscellaneous

This Agreement shall all be governed and construed in accordance with the laws of the State of Hawaii applicable to agreements made and to be performed in Hawaii. You agree that any legal action or proceeding between Interisland Airways and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Hawaii. Any cause of action or claim you may have with respect to any of our services must be in writing and submitted to our offices within 7 days after the claim or cause of action arises or such claim or cause of action is barred. Interisland Airways' failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Interisland Airways may assign its rights and duties under this Agreement to any party at any time without notice to you.

Cancellation Policy

Changes to your reservations are subject to change fee of 10% or $50.00 which ever is greater. Cancellations less than 72 hours prior to the day of service will result in a 100% charge being incurred/no refund. No show will result in a 100% charge/no refund.

Volcano National Park

At no time do we represent that you will see molten lava or an exploding volcano on our tour. Interisland Airways uses the Smithsonian Global Volcanism Program's definition of 'active', which is having erupted within the last 10,000 years. Seeing the Volcano area is dependent on weather conditions and the FAA rules governing the airspace around Volcano National Park. We also reserve the right at our discretion to change or alter, without notice any part or portion of any service or itinerary when conditions warrant.

Weather

The Hawaiian islands are easily described as a paradise, a virtual tropical oasis. Throughout Hawaii the weather is pretty regular with only a very slight annual seasonal change. The summer months extend from May through to October where the temperature usually sits at around 85 degrees Fahrenheit. Come November winter starts to set in and lasts through to April. Visitors will not notice much of a temperature change as there is only a drop in a couple of degrees. Unarguably Hawaii is a text book tropical weather dream destination. Each island can be said to have a wet and dry side. Winds blowing across the individual islands are usually forced upwards by mountains and volcanoes causing air to condense resulting in the formation of rain clouds. The windward side of any island is thus characteristically wetter. Generally speaking however the wettest months are during the winter, this said because the rainfall patterns are so localized the chance that the weather will put a damper on vacation plans are pretty slim. Interisland Airways cannot guarantee what type of weather you will encounter during the tour. All sites are based on weather permitting.

Operating Policies

You agree to comply with the Operating Policies set forth, which are the rules that govern your activity in connection with the service. Interisland Airways has the right but not the obligation to remove any communications and materials that Interisland Airways believes in its sole discretion violate the Operating Policies.

Use of the Service

You understand that, except for information, products or services clearly identified as being supplied by Interisland Airways, Interisland Airways does not operate, control or endorse any information, products or services on the Internet in any way. Except for Interisland Airways-identified information, products or services. Interisland Airways does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the service, any merchandise, information or service provided through the service. Interisland Airways does not warrant that the service will be uninterrupted or error-free or that defects in the service will be corrected. The service and any software made available on the service are provided on an "as is, as available" basis.

Equipment

Interisland Airways utilizes twin engine Bombardier shorts 360 aircraft equipped with Pratt & Whitney PT6-67R Engines each rated at 1424 HP. Our aircraft is operated by 2 pilots and 1 flight attendant. The crew is fully qualified and specially trained for the Hawaiian islands. Personal and Equipment are licensed and regulated by the Federal Aviation Administration.

Responsibilities

The itinerary’s described are operated by Interisland Airways and we act as agent only for all services other then the actual air portion of the tour. We disclaim all responsibility or liability of any nature whatsoever for loss of, delays, injuries, or damages caused by any company or persons employed in the operation of said services. This airline is not to be held responsible for any act, omission, or event during the time the passengers are not aboard their aircraft. We also reserve the right at our discretion to change or alter, without notice any part or portion of any service or itinerary when conditions warrant or to refuse or decline any person as a passenger on this tour at anytime. The passenger contract in use by this airline shall constitute the sole contract between the purchaser of this tour and this airline.

Charter Operations

All Charters between Interisland Airways and its customers will be governed under their individual contracts. Interisland Airways does reserve the right at our discretion to change or alter, any part or portion of any contract, service or itinerary when conditions warrant for weather, safety, and operational control.

Operating Costs

Interisland Airways reserves the rights to increase fares to reflect operational cost increases, including but not limited to fuel cost that is beyond our control.
